These terms of use (hereinafter «Terms of use») cover the basic rules of use of the site of the E-wallet «azwallet.az» Platform (hereinafter «Platform»). All conditions and requirements provided here ensure the correct and safe use of the Platform by Users based on the contract concluded between the Platform and the User. To become a user of the platform, it is necessary to accept and confirm these rules.
By entering the Platform, you confirm that you are fully familiar with these Terms of Use.
BASIC CONCEPTS:
The following definitions are used in these Terms of Use:
User – Physical person using payment services provided through the Platform;
E-wallet – a virtual account intended for the collection of funds on the User's account, which stores funds transferred by the User to the User's account in accordance with these Terms of Use;
Authentication – The process that allows you to confirm the identity of the User or the correctness of the use of the payment method, as well as the personalized security information of the User;
Personalized security information – specific personal information provided to the User by the Platform for authentication purposes;
Blocking – restriction of access to the User's account or full or partial suspension of payment operations in cases required by the legislation of the Republic of Azerbaijan or the internal rules of the Platform;
Privacy policy - The e-wallet platform must have appropriate policies and procedures to protect the confidentiality of user data;
The Platform Support Service - a special unit of the Platform for solving user issues and problems related to the E-wallet .
REGISTRATION PROCESS
To start using the E-wallet , the User must first go through the registration procedure. For registration, the User must be authorized on the Platform. After entering the system, select "Start using" and fill in the necessary information. These data include the name, surname, telephone number and e-mail address of the User.
The phone number and email address entered by the user will be used to activate the account, ensure security and restore the password. When registering, the user must create a reliable password. The password must have a length of at least 8 characters and include upper and lower case letters, numbers and special symbols. This is necessary to improve the security of the User's account.
In the process of registration, the User must also include 2 (two) factor authentication process. For this, the User needs to add additional security to his account by entering a temporary code sent to his phone. At this stage, the User may be required to provide additional documents for identity verification, such as a copy of an identity card or passport.
To complete the registration, the User must enter the confirmation code sent to the specified email address or phone number. This confirmation is intended for registration of the User. In some cases, the User needs to complete the registration by clicking on the confirmation link sent to the email.
After completing all these steps, the User can enter the E-wallet and use all the features of the Platform. This registration process ensures the security of the User's information and confirms that the account belongs only to the User.
AUTHENTICATION
The Platform can, at its discretion, authenticate the User before opening the E-wallet account or at any time after opening the E-wallet account. The selection of requirements, actions and methodological authentication is exclusively within the competence of the Platform, taking into account the requirements of the current legislation of the Republic of Azerbaijan.
Authentication measures can be implemented taking into account the amount of funds stored in the E-wallet, and/or the amount and quantity of completed payment operations. The first sentence of this clause does not limit the Platform's right to use authentication measures at any time and for any reason. The Platform informs the User about the authentication measures applied by publishing them on the Platform, by e-mail, SMS-notification or in another way.
The platform provides the User with personalized security information for remote authentication. The user must ensure the safety of such information.
OPENING AND ACTIVATION OF E-WALLET
The activation process of the E-wallet is an important stage for the User to start using the E-wallet. After completing the registration stage, the User must perform a number of actions to activate the E-wallet.
First, the User must receive a confirmation code sent to the email address or mobile phone number specified during registration. This code is necessary for confirming the registration of the user and activating the E-wallet. The verification code is intended to protect the security of the user's personal data.
The user must enter the received verification code in the corresponding field. This step confirms the ownership of the E-wallet to the User. The correct entry of the verification code is important for the activation of the E-wallet. In some cases, the User may be required to provide additional documents, for example, an identity card. This is intended for more accurate verification of the User's identity.
When the confirmation code is successfully entered, the user receives a notification about the activation of the E-wallet. After activation of the E-wallet, the User can carry out transfers, payments and other financial operations through the E-wallet.
The activation process of the E-wallet is intended to ensure the safety of the User's data and confirm the use of the account belonging only to the User. Completing these steps allows the User to use all the features of the E-wallet.
SECURITY PROCEDURES OF E-WALLET
For the safety of the E-wallet , the user must take the following measures:
You should not share your password to third parties, you must notify the Platform support service in case of any password violation;
To increase the security of the account, the user needs to activate the function of 2 (two) factor authentication;
Do not forget to close the E-wallet when you are not using the E-wallet.
TRANSFER OF FUNDS TO E-WALLET
Money can be transferred into the User's e-wallet account through all payment systems presented on the Platform, as well as through payment terminals on the territory of the Republic of Azerbaijan.
After the user confirms the transaction, the transferred funds are immediately added to the Electronic Wallet. The User is also sent a confirmation message about the successful completion of the receipt of funds.
In case of failure of the operation, the User should contact the support service of the Platform.
PROCESSING OF PAYMENTS AND TRANSFER
For each payment operation, the User requires the necessary information to complete the payment. The list of necessary information provided by the Platform to the User before the implementation of the payment operation, and the term of its provision are determined by the Platform unilaterally, taking into account the requirements of the legislation of the Republic of Azerbaijan. The user must correctly provide all the necessary information. Providing incorrect information may lead to a delay in payment or its failure. The user must enter the payment amount and the relevant information.
After confirming the payment, the user receives information about the successful completion of the payment. A confirmation message will be sent to the User for each payment operation. Notifications confirming the success of the payment operation are sent to the User's email or via SMS notification.
The User can also make money transfers to other Users through the E-wallet. The transfer process consists of the following stages:
The user must enter the amount he wants to transfer and the other party's information (phone number or email address). It is important to check the accuracy of this information, since the provision of incorrect information may lead to the fact that the transfer of funds will not take place;
After the user confirms the transfer operation, the relevant amount is debited from his e-wallet and transferred to the account of the other party. The User is also notified of the successful completion of the transfer operation.
The user declares and guarantees that he will not participate in money laundering and financing of terrorism when transferring money to other people using the Platform. This includes:
Direct personal participation (independently or jointly with others);
Organization of committing actions by other persons;
Incitement of other persons to commit an act;
Providing support to other persons when committing an act.
The platform declares that it strongly condemns the act of money laundering and terrorism financing and will not participate in such actions under any circumstances.
PROTECTION OF USER’S INFORMATION
The Platform processes, protects and does not disclose the User's personal data to third parties in accordance with the legislation of the Republic of Azerbaijan and the Privacy Policy of the Platform. The User's data may be disclosed to third parties only in accordance with the requirements of the legislation of the Republic of Azerbaijan and with the written consent of the User.
Personal information is collected only for the purposes specified and authorized by the User.
The Platform declares and confirms that the User's data is stored only as long as it is necessary, and that strict security measures are used to protect the data, which prevent the loss or theft of the data.
User’s data is used only to provide services related to the User, to implement payment operations and to communicate with the User. The data can be used for any other purposes only with the written consent of the User.
Modern encryption technologies and security programs are used to protect data. This helps protect data from third parties.
Personal data of users must be accurate and up-to-date. Users must notify the Platform of changes to their data.
Users have the right to access their data, request deletion or correction of data. These rights are guaranteed in accordance with the legislation of the Republic of Azerbaijan.
COMBAT WITH ILLEGAL ACTIVITY
The parties declare that they are combating money laundering, terrorism financing and tax evasion.
The User bears full responsibility for the legality of the source of funds used in all payment operations carried out on the Platform, as well as in the case of receipt of funds in the User's E-wallet , the source of which there are reasonable doubts, including the payment operation itself for the purpose of legalization of funds, received as a result of financing terrorism or other criminal activities, is obliged to immediately inform the Platform and law enforcement authorities when the User learns or should know about it, or if the User has reasonable doubts about the purpose of the payment operation.
The user declares that he has not avoided and will not avoid paying taxes and other mandatory payments in the Republic of Azerbaijan or other countries in connection with the use of the Platform or through the Platform. The user is fully responsible for paying all taxes, tax evasion and other mandatory payments provided by the legislation of the Republic of Azerbaijan in connection with transactions carried out on the Platform. The Platform may at any time request additional documents from the User regarding payment operations performed by the User.
WITHDRAWAL OR BLOCKING OF THE E-WALLET
Cancellation or blocking of the User's E-wallet by the Platform may be carried out in accordance with the legislation of the Republic of Azerbaijan, the Privacy Policy and other requirements.
Cancelling an account means the complete closure of the User's E-wallet. The User, for example, can do this when he wants to stop using the E-wallet. The user must perform the appropriate cancellation procedures of the E-wallet and disclose the reasons for the cancellation. Cancellation of the e-wallet entails the deletion of all user data.
Cancellation or blocking of an e-wallet is carried out by the Platform for certain reasons. These reasons may include:
As a result of the actions of the User, contrary to the legislation of the Republic of Azerbaijan, including financial and tax legislation, including violations of property rights or illegal activity;
E-wallet of the User represents a security threat, for example, in case of suspicious transactions or violation of authentication information;
Non-observance by the User of the Privacy Policy of the Platform, including unauthorized dissemination of information or access to the information of other persons;
The e-wallet participates in the financing of terrorism or other criminal activity;
The e-wallet is inactive for 1 (one) year or does not fulfil the User's request for access to the E-wallet ;
Non-compliance by the User with the requirements of the Platform;
By the initiative of the User.
This list is not final and may be updated with additional provisions. At the same time, this list can be expanded in other cases provided by the legislation of the Republic of Azerbaijan, as well as by a court decision or the request of an authorized state body.
In case of blocking of the E-wallet, the Platform will attempt to inform the User about the reasons for the Blocking. The blocking period is determined by the Platform at its discretion. The user can turn to the Platform to understand the reasons for blocking and solve problems.
In any case, the blocking period is determined by the internal rules of the Platform in accordance with the requirements of the legislation of the Republic of Azerbaijan, if the User has familiarized himself with these internal rules in advance.
RESPONSIBILITY
The parties are responsible for the violation of these Terms of Use in accordance with the legislation of the Republic of Azerbaijan.
User's Responsibility
The user bears full responsibility for the legality of all operations carried out on the Platform. He guarantees that the source of the funds used by him is legal;
The user undertakes to comply with the rules, policies of the Platform and legislation of the Republic of Azerbaijan. In case of any violation, he bears the corresponding responsibility.
Platform Responsibility:
The platform takes appropriate technical and organizational measures to ensure the security of its Users' data. Bears responsibility for losses of User in cases of data leakage, as well as a result of unauthorized use of the User's data;
The platform must respect the rights of the User and provide him with a fair and transparent service. He must implement appropriate control systems to ensure the accuracy of User transactions;
The Platform has the right to request additional documents related to operations performed by the User, but is obliged to implement these requests in a conscientious and legal manner.
Payment for losses:
If one of the parties caused damage to the other party, he is responsible for compensation for the actual damage caused.
APPLICABLE LAW AND DISPUTE RESOLUTION
The current legislation of the Republic of Azerbaijan is applied to these Terms of Use and the relationship between the User and the Platform
The parties will try to resolve the dispute through mutual negotiations before going to court for disputes arising between the User and the Platform.
In case of failure to reach an agreement between the parties, the dispute will be resolved in the appropriate court in accordance with the current legislation of the Republic of Azerbaijan.
ADDITIONAL CONDITIONS
The Platform may make changes to these Terms of Use without the consent of the User. If the User does not agree with the changes made, he can stop using the Platform. If the User continues to use the Platform, he agrees with all changes and accepts the new version of the Terms of Use in full.
If not specified otherwise, the new Terms of Use come into force from the moment of publication on the Platform.
